These Terms of Service ("Terms") govern your access to and use of the 4cast-ai platform provided by 4cast-ai Ltd ("4cast-ai", "we", "us"). By creating an account or using the platform, you agree to these Terms. This is a template provided in good faith and should be reviewed by your legal adviser before relying on it.
4cast-ai is a web-based, multi-tenant software platform that produces sales forecasts (depletions and shipments) for wholesale and FMCG businesses, with promotional modelling, Annual Operating Plan benchmarking, accuracy tracking, a natural-language assistant and an administrative console. We may add, change or remove features over time.
You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for activity that occurs under your account. Access is organised by organisation: an organisation administrator may invite users and control which data each user can access. You must not share logins, attempt to access another organisation's data, or attempt to circumvent the platform's security or access controls.
Your administrator may cancel an individual seat or the whole subscription from the platform's settings. Cancellations take effect at the end of the following month; you retain access until that date. Enterprise contracts are governed by their own terms.
You retain all rights in the data you upload ("Customer Data"). You grant us a limited licence to host and process Customer Data solely to provide the service. We process personal data in accordance with our Privacy Policy. Customer Data is logically isolated per organisation using database-level access controls. On termination, you may export your data, after which it is deleted in line with our Privacy Policy and any applicable Data Processing Agreement.
You agree not to: use the platform unlawfully; upload data you are not entitled to use; attempt to gain unauthorised access to the platform or other organisations' data; interfere with or disrupt the service; reverse-engineer the platform; or use it to build a competing product.
The platform produces forecasts and recommendations to support your commercial decisions. Forecasts are estimates based on the data you provide and the platform's models; they are not guarantees of future results. You are responsible for the decisions you make using the platform. The service is provided "as is" and "as available"; to the maximum extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We aim to keep the platform available and to maintain it responsibly, but we do not guarantee uninterrupted availability unless a separate service-level agreement is in place. Planned maintenance and updates may cause occasional downtime.
The platform, including its software, design, and content (excluding Customer Data), is owned by 4cast-ai Ltd and protected by intellectual-property laws. These Terms do not transfer any ownership of the platform to you.
Each party agrees to keep the other's confidential information confidential and to use it only as needed to perform under these Terms. Your Customer Data is treated as your confidential information.
To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential losses, or loss of profit, revenue or data. Our total aggregate liability arising out of or related to the service is limited to the fees paid by you to us in the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
You may stop using the platform and cancel as described above. We may suspend or terminate access if you materially breach these Terms, do not pay fees due, or use the platform in a way that risks harm to the service or other users.
We may update these Terms from time to time. Material changes will be notified by email or in-app, and the "last updated" date above will change. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless otherwise agreed in an enterprise contract.
